We walked away as one of the two winners of the Fintech Meetup Pitch Competition in Las Vegas last week. After a competitive selection process with 200+ applicants narrowed down to 12 finalists, we were one of two companies that won.
Our CEO & Founder, Austin Carroll, delivered the winning pitch, spotlighting a shift we’re seeing across the industry. That message resonated, and the response in the room made it clear this problem is top of mind.

🔍 The AI Targeting Race Has a Compliance Problem

A fintech startup’s marketing team had built something they were genuinely proud of. Their AI predicted payday gaps, tracked spending dips, and timed loan offers perfectly. Open rates were incredible. Someone booked a celebratory lunch.
Then a regulator pulled the thread.
The same algorithm was quietly serving higher-interest products to users in certain zip codes more often than others. Nobody programmed it that way. The model had learned patterns from historical data that reflected existing inequalities in who had previously borrowed at what rate. The machine found a shortcut. The shortcut already had a name in law.
This is the story of AI personalization in financial marketing right now. The technology is impressive. The blind spots are dangerous. Most teams are focused on the first part.
📊 Two Numbers Worth Sitting With
Recent consumer surveys show comfort with AI-driven financial recommendations has roughly doubled since 2023, with more than two-thirds of customers now open to personalized product suggestions from AI tools. The business case is solid.
But an overwhelming majority of those same customers say they would switch providers for one that was more transparent about how their data is used. Not might consider it. Would do it.
The gap between personalization that feels like a service and personalization that feels like surveillance is where most of the risk lives.
⚖️ The Algorithm Cannot Plead Ignorance
The law does not care how a decision got made. Fair lending regulations apply whether a loan offer was shaped by a human or a machine. A real case makes this concrete.
A major US credit card issuer’s AI fraud system began flagging a disproportionate number of legitimate transactions by Spanish-speaking customers. The model had treated location and language patterns as risk signals with no human instruction. Regulators found it discriminatory, demanded model transparency, and required a full overhaul.
That was a fraud model. The same logic applies to any system shaping what financial products a person sees, and when. Marketing is not exempt because it feels friendlier than underwriting.
🎯 Where the Exposure Actually Lives
The legal risk no longer sits in the language of an ad. It lives in the system deciding who sees what and why.
For financial brands running AI-driven campaigns, the exposure hides in three places most marketing teams are not checking:
The targeting logic and whether it would survive scrutiny under fair lending law
The data sources feeding the segmentation model, including what proxies the model may have silently learned
The gap between what the privacy policy says and what the system actually does
Colorado’s AI Act, coming into force mid-2026, requires impact assessments and consumer disclosures for high-risk AI systems. Those assessments take months to prepare. The question for most financial brands is not whether this is coming. It is whether preparation started in time.
🏆 Winning Looks Like Transparency, Not Restraint
The brands navigating this well are not pulling back on the technology. They are the ones who can explain exactly why a specific person was shown a specific offer, and why that decision was fair. In practice that means:
Giving customers visible control over personalization settings, not just a buried privacy toggle
Running bias audits on targeting models before campaigns go live, not after a complaint arrives
Treating transparency as a product feature rather than a legal footnote
The brands most likely to win durable consumer trust will not be the ones with the most sophisticated targeting. They will be the ones who can explain it.
🏛️ FTC Warns Payment Giants Over “Debanking”
The Setup: “Debanking” concerns are growing as payment platforms suspend or terminate accounts, effectively cutting off access to digital commerce. These decisions are typically framed as risk or policy enforcement but are drawing regulatory attention.
What Happened: FTC Chairman Andrew N. Ferguson sent warning letters to the CEOs of PayPal, Stripe, Visa, and Mastercard, warning that restricting services in ways that contradict public policies or customer expectations could violate the FTC Act.
The Context: The move extends scrutiny beyond banks to payment infrastructure providers that control access to payment rails.
The Takeaway: Access decisions are becoming a compliance issue, not just a risk decision. Regulators are signaling that how companies restrict services, and how clearly those decisions are explained, may now fall under consumer protection scrutiny. Payment platforms and fintechs may face exposure not just for claims, but for enforcement policies that determine who can transact.

🚨FINRA Says Your AI Tools Are Already Regulated
FINRA's 2026 Regulatory Oversight Report includes a dedicated section on generative AI for the first time, making clear that existing rules on supervision, communications, and recordkeeping apply fully when firms use AI tools. The regulator also flags specific risks including hallucinations, bias, and AI agents acting beyond their intended scope without human oversight. Read more
🚨 US Treasury Convenes Financial Sector on AI Governance
The US Treasury and the Financial Stability Oversight Council launched a public-private AI Innovation Series on April 1, 2026, bringing together financial institutions, technology firms, and regulators to develop practical AI governance frameworks. 🚨 SEC Overhauls Enforcement Playbook for the First Time Since 2017
The U.S. Securities and Exchange Commission (SEC) released its first major update to the Enforcement Manual since 2017, introducing changes designed to improve how investigations are conducted and communicated. The revisions emphasize greater fairness, transparency, and efficiency, including clearer processes and more engagement with individuals under investigation. Read more

“We launched a new product page, and a partner copied our messaging into their own marketing without our review. Are we responsible for claims made using our language?”
Potentially, yes. Regulators often look at whether a company influenced, approved, or reasonably expected third parties to use its messaging. If a partner is using your language to promote your product, those claims can still be attributed to you, especially if you benefit from the promotion.
This is why many financial brands treat partner and affiliate content as an extension of their own marketing. The safest approach is to provide approved language, set usage guidelines, and monitor how partners represent your product.
